By using neuraposter (the “App”), you agree to these Terms. If you don’t agree, don’t use the App.
1) Eligibility
The App is intended for people old enough to use major social platforms. It’s not designed for children.
2) Accounts & security
You must create an account (email + password). You’re responsible for keeping your credentials secure and for all activity under your account. We may require reasonable steps to verify your identity for support requests (including account deletion).
3) What the App does (and doesn’t do)
neuraposter generates captions and hashtags. It provides suggestions only. We do not guarantee any outcome (reach, engagement, conversions, follower growth, virality). You are solely responsible for what you post, when you post, and the results.
4) How generation works (AI + availability)
By default, when you select an image for caption generation, neuraposter sends the image and the accompanying prompt information to Gemini 2.5 Flash through the Gemini 2.5 Flash API. Gemini 2.5 Flash analyzes the image on Gemini 2.5 Flash-operated or Gemini 2.5 Flash-contracted infrastructure and returns image-derived context used to generate the caption and hashtag suggestions. Image analysis is therefore performed by Gemini 2.5 Flash, not solely on your device.
neuraposter does not retain the selected image on its own servers as product content. Gemini 2.5 Flash may process and temporarily retain API inputs and outputs in accordance with Gemini 2.5 Flash’s applicable terms, data controls, security requirements, and legal obligations. Depending on Gemini 2.5 Flash’s infrastructure and the data-residency controls available to neuraposter, this processing may occur outside Switzerland, the European Union, or the European Economic Area. Service quality and speed can vary, and the service may be delayed, rate-limited, or temporarily unavailable (e.g., provider downtime, network issues, maintenance).
Gemini 2.5 Flash does not use API inputs or outputs to train or improve its models by default unless the API customer explicitly opts in to share that data. Gemini 2.5 Flash’s retention and data-control rules may change over time.
5) Your content, rights, and responsibility
You own your photos/videos and brand assets. You grant us a limited right to process your inputs solely to operate the App and provide outputs. You represent that you have the rights to use any content you upload/select and that your use complies with laws and platform rules. You are responsible for reviewing/editing outputs before posting (including claims, disclosures, or regulated statements).
No professional advice: Output may be incorrect or inappropriate. The App does not provide legal, medical, financial, or professional advice.
6) Prohibited use (misconduct / abuse)
You may not use the App to:
- break laws or platform rules, or generate hateful/harassing/violent/illegal content
- impersonate others, mislead users, or run scams
- automate, scrape, reverse engineer, exploit, or bypass usage limits
- interfere with service stability, security, or other users
We may suspend/terminate accounts, throttle usage, or refuse service where we reasonably believe there is abuse, fraud, or risk.
7) Plans, caption credits, pricing, and service changes
Plans may include a specified number of caption-generation credits or other usage limits for each billing period. The price, renewal period, included credits, and principal features applicable to a purchase are displayed in the App before purchase. Unless the offer expressly states otherwise, unused credits included with a recurring plan do not roll over to a later billing period and have no cash value.
Caption generation depends on third-party artificial-intelligence and infrastructure providers, including Gemini 2.5 Flash. The cost of operating neuraposter may change because of circumstances outside our reasonable control, including material increases in model-input, model-output, image-processing, hosting, currency-conversion, tax, regulatory-compliance, or App Store costs.
If those costs materially increase, or if a provider materially changes or discontinues a service on which neuraposter depends, we may make a reasonably necessary and proportionate adjustment to the price of a plan, the credits or usage included in a future billing period, or the technical configuration used to provide the App. Where reasonably practicable, we may instead use a different model, provider, or technical configuration offering substantially comparable core functionality. Nothing in this section permits us to charge a new or increased subscription price without following Apple’s applicable procedures and mandatory law.
We will not retroactively reduce credits or principal plan benefits already purchased for the then-current paid billing period. A material adverse change to a paid plan will ordinarily take effect no earlier than the next renewal date. We will provide reasonable advance notice through the App, by email, through the App Store, or by another durable means available to us. The notice will describe the material change, its effective date, and how to manage or cancel the subscription.
If you do not agree to a change that will apply to a future renewal period, you may cancel before renewal and continue using the benefits of your current paid period until it ends. If a change prevents us from providing a material paid benefit during the current paid period, we will provide any remedy required by applicable law and may also provide an appropriate remedy under Section 9.
We may change, suspend, or discontinue Free-plan credits, trial credits, promotional credits, and features provided without payment on a prospective basis. Where reasonably practicable, we will provide notice before a material adverse change. This does not affect credits separately purchased for payment or any mandatory rights under applicable law.
8) Payments, subscriptions, cancellations (Apple is the transaction partner)
Paid plans are sold via Apple In-App Purchase. Apple acts as the merchant of record for Apple IAP transactions, meaning Apple is the direct seller/payment processor in the transaction and manages billing and receipts.
Subscriptions renew automatically unless cancelled in your Apple ID settings.
Any subscription price increase will be implemented in accordance with Apple’s applicable notice and consent procedures and mandatory local law. Where Apple or applicable law requires your consent, the subscription will not renew at the increased price unless you provide that consent. If consent is not provided, the subscription may expire at the end of the then-current paid billing period. You may cancel before renewal if you do not wish to continue at the new price.
Refund eligibility and processing are handled by Apple under Apple’s policies and refund flow.
neuraposter may later receive proceeds from Apple (typically consolidated payouts), but Apple remains the payment processor/merchant for the user transaction.
9) Service issue remediation (fair, but controlled)
If you paid for a plan and the core paid feature (caption/hashtag generation) is unavailable for an extended period due to a neuraposter-side issue, we may offer, at our discretion and where permitted:
- service credits,
- an extension of your subscription period, or
- an equivalent in-app remedy.
Because billing is processed by Apple, monetary refunds are generally handled through Apple’s refund process.
10) Training / data sharing choice
Where applicable, neuraposter may opt in to Gemini 2.5 Flash’s API data-sharing program for Free users. If enabled, the API inputs and outputs shared with Gemini 2.5 Flash may include selected images, prompts, image-analysis results, captions, and hashtags, and Gemini 2.5 Flash may use that shared data to evaluate or improve its models. Premium users are excluded from this optional data sharing. See the Privacy Policy for details.
11) Disclaimer of warranties
The App is provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free service or that output will meet your expectations.
12) Limitation of liability (strong, but standard)
To the fullest extent permitted by law:
neuraposter is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, goodwill, reputation, data, or business opportunities.
neuraposter’s total liability for any claim arising out of or relating to the App will not exceed the amount you paid to neuraposter for the App in the 12 months before the event giving rise to the claim (or, if that’s not permitted, the minimum allowed by law).
13) Indemnity (protects you against “misconduct users”)
You agree to defend, indemnify, and hold neuraposter harmless from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- your content, your posts, or your misuse of the App,
- your violation of these Terms, laws, or third-party platform rules, or
- your infringement of any rights of any person or entity.
14) Suspension, termination, and access
We may suspend or terminate access if you violate these Terms, attempt fraud/abuse, or if required for security/legal reasons. You may stop using the App at any time.
15) Changes to Terms
We may update these Terms to reflect legal, regulatory, security, technical, provider, operational, or product changes. The effective date above identifies the current version.
If a change materially and adversely affects an existing paid subscription, we will provide reasonable advance notice and apply the change prospectively, ordinarily from the next renewal period. Where required by Apple or applicable law, we will request your consent. If you do not agree, you may cancel before the change takes effect.
Changes will not retroactively remove paid benefits already provided or due for the then-current paid billing period, except where an immediate change is required by law or is reasonably necessary to address fraud, abuse, a material security risk, infringement, or a provider outage or discontinuation that makes continued performance impracticable. In that situation, we will take reasonable steps to limit the effect on users and provide any remedy required by applicable law.
For changes that do not materially and adversely affect an existing paid subscription, the updated Terms will apply from the stated effective date. Your continued use of the App after that date constitutes acceptance to the extent permitted by applicable law. Nothing in these Terms limits mandatory consumer rights.

17) Governing law
These Terms are governed by the laws of Switzerland, with venue in Zurich, unless mandatory consumer-protection rules apply.
